CBT Technology Institute Title IX Non-Discrimination Policy

1. Introduction

CBT Technology Institute is committed to maintaining an educational and workplace environment free from sex-based discrimination, harassment, and retaliation. In accordance with Title IX of the Education Amendments of 1972, CBT prohibits discrimination on the basis of sex in all its programs and activities, including admissions and employment.

This policy outlines CBT’s procedures for addressing complaints of sex discrimination, sexual harassment, and retaliation, and ensures a prompt, fair, and impartial resolution process.

2. Title IX Coordinator

The Title IX Coordinator is responsible for overseeing compliance with this policy, including intake, investigation, resolution, and implementation of supportive measures.

3. Reporting and Complaints

Any person may report sex discrimination, sexual harassment, or retaliation to the Title IX Coordinator. Reports may be made in person, by mail, or electronically at any time.

A Formal Complaint is a document filed by a Complainant or signed by the Title IX Coordinator requesting an investigation.

4. Initial Response and Supportive Measures

Upon receiving a report or complaint, CBT will:

  • Conduct a threat assessment.
  • Offer supportive measures (e.g., counseling, schedule adjustments, no-contact orders).
  • Inform the Complainant of their rights and options, including filing a Formal Complaint.

Supportive measures are available regardless of whether a Formal Complaint is filed.

5. Emergency Removal and Administrative Leave

CBT may remove a Respondent from its programs or place an employee on administrative leave if they pose an immediate threat to safety.

6. Dismissal of Complaints

Complaints may be dismissed if:

  • The conduct does not meet Title IX definitions.
  • The conduct occurred outside CBT’s jurisdiction.
  • The Complainant withdraws the complaint.
  • The Respondent is no longer affiliated with CBT.

7. Informal and Alternative Resolution

CBT may offer informal resolution if both parties consent. Options include:

  • Mediation
  • Educational interventions
  • Agreements between parties

Participation is voluntary and may be terminated at any time.

8. Formal Grievance Process

If informal resolution is not pursued, the Formal Grievance Process includes:

  • Investigation by trained personnel
  • Review of evidence by both parties
  • Live hearing with cross-examination conducted by advisors
  • Final determination based on clear and convincing evidence

9. Hearings and Determinations

  • Conducted by neutral Decision-makers
  • Only relevant, non-privileged evidence is considered
  • Advisors conduct cross-examination
  • Determination is provided in writing to both parties

10. Sanctions and Remedies

Sanctions may include:

For Students:

  • Warning, probation, suspension, expulsion, diploma withholding

For Employees:

  • Counseling, training, probation, suspension, termination

11. Appeals

Appeals must be submitted within three business days and may be based on:

  • Procedural irregularity
  • New evidence
  • Conflict of interest or bias

Appeals are reviewed by impartial personnel and decisions are final.

12. Retaliation

CBT prohibits retaliation against any individual involved in a Title IX process. Retaliation should be reported immediately and will be investigated.

13. Confidentiality

CBT will maintain confidentiality to the extent possible, consistent with FERPA and other applicable laws.

14. Mandatory Reporters

Designated CBT personnel are required to report known or suspected Title IX violations to the Title IX Coordinator.

15. Record Retention

CBT will retain all Title IX-related records for a minimum of seven years.

16. Policy Review and Publication

This policy will be reviewed periodically and updated as necessary. It will be published on CBT’s website and in institutional materials.
